Definitions

“The Driver” means The Drivers Room LTD of 16 Portland Street, Clifton, Bristol , BS84JH.

“The Client” means the individual or organisation set out on the booking page annexed to these terms and conditions.

 “Event” means the specific event details on the booking page annexed to these terms and conditions.

Website

The Drivers Room LTD tries to ensure that the information contained in our correspondence and on our website are as accurate as possible. Inaccuracies may arise from time to time. The Drivers Room LTD accepts no responsibility for any errors in the information contained and can amend them accordingly to represent accurate information.

Pricing

The current prices are shown on our website and will be confirmed at the time of booking. We reserve the right to change any of the prices advertised on our website without prior notice.

Upon receipt of an order, an invoice will be raised and payment terms are as per invoice. Any queries arising from an invoice must be notified to The Drivers Room LTD upon receipt of invoice. The Drivers Room LTD reserves the right to cancel and re-allocate any booking/s, without further notification to the Client if the Client does not adhere to these time limits.

All bank charges to be met by the Client and in the event that payment arrives less than the bank charges a further invoice will be raised. There shall be no formal and binding contract between The Drivers Room LTD and the Client until the requested deposit (or where appropriate the full amount due) has been received. Failure to pay the balance of any deposit (or where appropriate the full amount due) as requested will entitle us to cancel the booking without further advance notice to you.

All prices are quoted in GBP, The Drivers Room LTD reserves the right to add a service charge of 2.5% on all payments made by credit card and any currency/bank charges that may have incurred.

Booking and Payment

All events are offered subject to availability and on a strictly first come first served basis. Any Event taking place within the UK must be paid for in full when the booking is made. Any Event taking place outside the UK must be paid for in full no later than eight weeks prior to the date of the event with a deposit paid when the booking is made.

Provisional bookings will be confirmed only once payment is received in full. We reserve the right to cancel or refuse any bookings at our sole discretion.

Cancellation Policy

If for any reason whatsoever an event shall be cancelled, The Drivers Room LTD will reimburse or give credit to the Client for the full value of any refund received from the venue or supplier.

If the Client wishes to cancel, they can do so in writing the latest fourteen days prior to the event. Any time after this, the Client will be liable for 100% of the full event price. The Drivers Room LTD will endeavour to resell the package/s on the Client’s behalf, at which point, if successful, a full refund less 10% of the full value will be made.

If the Client wishes to cancel within fourteen days of the event for which they have booked we will only credit their account with the full amount less a £50 administration fee if we are able to re sell the place.

Any credit issued will not be transferable and must be used within twelve months.

There shall be no refund made by The Drivers Room LTD if the Event is terminated either on the day of the Event or shortly before as a result of adverse weather or other matters which in our reasonable opinion are beyond our control provided that we will use our reasonable endeavours to arrange a replacement event at such additional costs (if applicable) as are reasonably obtainable.

Risks Associated with the Event

The Client acknowledges and realises that their participation in any Event is potentially dangerous and that there are numerous risks associated with it. The Client fully understands and realises that their participation in any Event may result in serious bodily injury and/or death to themselves or others.

With the full knowledge and understanding of the potential risks referred to above and associated with your participation in the Event, The Client enters the Event voluntarily and fully accept and assume every such risk for loss, damage or injury (including death).

Waiver of Liability

In consideration of The Client being permitted to take part in the Event, they waive, release and discharge for themselves, their executors, administrators and legal representatives all or any rights and/or claims which they have or may have in the future against The Drivers Room LTD, our officers, directors, employees, consultants, agents and sponsors for all and any damages, injuries (including death), and/or claims which may be sustained by them directly or indirectly arising from their participation in the Event, which shall include the application of emergency or medical services at the Event, except to the extent that personal injury or death are caused directly by the negligence, error or omission of those persons listed above.

Further, The Client agrees not to hold liable The Drivers Room LTD our officers, directors, employees, consultants, agents or sponsors for all or any damages, injuries (including death) and/or claims which may be sustained by them directly or indirectly arising out of their participation in the Event except to the extent that personal injury or death are caused directly by the negligence, error or omission of those persons listed above. This waiver shall include but not in any way be limited to all claims for property damage or financial loss and shall also include all legal costs otherwise recoverable arising from such claims.

Having given the above waiver, The Client fully understands its terms and understand that they have relinquished significant rights by doing so. They have done this at their own free will and without any coercion or duress from any third party.

In relation to third parties, The Drivers Room LTD accepts no liability for loss, damage or injury to any person or their property, howsoever caused. With all arrangements involving a third party The Drivers Room LTD acts only as the agent of the Client and so no liability whatsoever shall be attached to The Drivers Room LTD in connection with, or arising from, arrangements between the Client and of the third party.

In the unlikely event of natural disaster, global pandemic or a terrorist attack, The Drivers Room LTD can not be held liable for the event not taking place in any way.

Indemnity

The Client hereby agrees to fully release and unequivocally indemnify The Drivers Room LTD, our officers, employees, consultants, agents, sponsors, licensees and assigns from all and any claims, demands, damages, liabilities or legal action arising directly from The Client’s negligence, error or omission at any Event whether made or claimed before, during or after the Event and which shall include all associated reasonable costs and expenses.

The Client further agrees that where any initial booking payment has been made by them using a credit card, The Drivers Room LTD shall be entitled to deduct such further sums from their credit cards as are necessary to reimburse us for all and any reasonable costs or fees incurred as a result of any damage caused by The Client or any persons forming part of their group at any Event.

General

Unless The Drivers Room LTD have first agreed in writing, we are not bound by any variation to these terms and conditions.

The Client agrees and accepts all of these terms and conditions and understands that whilst The Drivers Room LTD will use their reasonable efforts to ensure that all other participants at the Event abide by these terms and conditions, we cannot guarantee that these terms and conditions will at all times be complied with nor be held responsible or liable in any way for their non-compliance.

The Client agrees that by accepting these terms and condition, they are entering into a legally binding agreement with The Drivers Room LTD to participate in the Event on our terms and conditions.

The Client declares that all the information supplied by them is the best of their knowledge and belief correct and that they have read and understood the terms and conditions and agree to all of them (including but not limited to those relating to waiver of liability and indemnity) in full.

If we feel it is necessary to take any action to enforce these terms and conditions, we will be entitled to recover from The Client, and they agree to pay, all reasonable and necessary legal fees, in additional to any other relief, at law or in equity to such an entitlement by us.

The Client further understands that whilst The Drivers Room LTD will make every effort to ensure that The Client’s personal information is kept private, we shall not be held responsible nor liable should any information be lost or stolen by any third party.

Declaration and Indemnity

While attending this or any other event organised by The Drivers Room LTD, the Client hereby acknowledges that they do so entirely at their own risk and that no claim whatsoever kind arising from their own negligence injudicious act or omission or otherwise shall be made by them or on their behalf or on behalf of any of my dependents against The Drivers Room LTD.

The Client agrees to the above conditions and hold harmless The Drivers Room LTD against any liability arising here under.

The Client understands that The Drivers Room LTD accepts no responsibility for any loss or damage to any items brought to an Event.

It is important that The Client reads and understands the declaration and indemnity and terms and conditions that apply.

This contract is subject to the law of England and Wales.
